By accessing or using Wambesh ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

These Terms are a legally binding agreement between you and Wambesh. By creating an account, you confirm that you have read, understood, and accept these Terms and our Privacy Policy.

Wambesh is a free movie and TV show streaming platform with developer APIs and community features. The Service includes:

• Free streaming content with no advertisements
• User accounts with profile management, security features, and preferences
• Community features including ratings, reviews, and watchlists (coming soon)
• Developer APIs for accessing movie and TV show data (paid tiers coming soon)

We can't guarantee 100% uptime, uninterrupted access, or that every feature will always be available. We do our best, but things can break.

When you create an account, you agree to:

• Provide accurate and complete registration information
• Keep your credentials safe (password, 2FA codes, backup codes)
• Let us know right away if someone accesses your account without permission
• Take responsibility for everything that happens under your account
• Not create multiple accounts to abuse the platform
• Be at least 13 years old

We may suspend or terminate accounts that break these rules. Each account is limited to 3 concurrent sessions.

You agree not to use the Service to:

• Break any laws or regulations
• Infringe on anyone's intellectual property rights
• Spread malware, spam, or harmful content
• Try to access our systems or other users' accounts without permission
• Get around rate limits, security measures, or access controls
• Scrape, crawl, or harvest content or user data without authorization
• Use bots or automated tools to create accounts or degrade platform performance
• Impersonate any person or entity
• Post deepfake, AI-manipulated, or synthetically generated media that misrepresents real people
• Engage in hate speech, harassment, or targeted abuse of other users

The Wambesh platform — its design, code, and branding — belongs to Wambesh. Content available through the Service may be subject to third-party rights.

Your content (reviews, ratings, comments) stays yours. By posting on Wambesh, you give us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote it within the Service.

Copyright complaints: If you believe content on Wambesh infringes your copyright, send a DMCA takedown notice to legal@wambesh.com with: (1) a description of the copyrighted work, (2) the URL of the infringing content, (3) your contact information, and (4) a statement under penalty of perjury that you are authorized to act on the copyright owner's behalf. We respond to valid notices promptly and will terminate accounts of repeat infringers.

Wambesh developer APIs are under development. When available, API access will be governed by separate API terms with tiered pricing (free tier with rate limits, paid tiers for higher volumes).

API consumers will need to register for API keys, respect rate limits, and follow data usage rules. You may not resell API data, use it to build competing services, or strip attribution. Detailed API terms will be published before launch.

To the maximum extent allowed by law, Wambesh is not liable for any indirect, incidental, special, consequential, or punitive damages — including lost data, profits, or business opportunities — arising from your use of the Service.

Our total liability for any claim under these Terms won't exceed the amount you paid us in the 12 months before the claim (if any).

Nothing here limits liability that can't be excluded by law, such as liability for fraud or for death or personal injury caused by negligence.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We don't promise that the Service will be uninterrupted, error-free, secure, or that any content will always be available.

We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. You use the Service at your own risk.

You agree to indemnify and hold Wambesh harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your misuse of the Service
• Content you post or share on the platform
• Your violation of any third-party rights

We're not liable for delays or failures caused by events beyond our reasonable control. This includes natural disasters, power outages, internet service disruptions, government actions, pandemics, cyberattacks, or infrastructure failures.

If such an event happens, we'll do our best to restore the Service as quickly as possible and keep you informed.

You can delete your account at any time through the account deletion settings. There's a 30-day grace period during which you can change your mind.

We may suspend or terminate your account if you break these Terms, engage in abusive behavior, or if the law requires it. We'll let you know unless we're legally prevented from doing so.

These Terms are governed by applicable law. Any disputes should be resolved through good-faith negotiation before formal legal action.

If you're a consumer in the European Union, nothing here affects your statutory rights under mandatory consumer protection laws in your country.

If any part of these Terms is found to be unenforceable, the rest remains in full effect. The unenforceable part will be interpreted as closely as possible to its original intent.

These Terms, together with our Privacy Policy and Cookie Policy, make up the entire agreement between you and Wambesh, replacing any prior agreements.

We may update these Terms from time to time. When we make important changes, we'll update the date at the top and may notify you through the Service.

Continuing to use Wambesh after changes means you accept the updated Terms. If you disagree, stop using the Service and delete your account.
